1. Acceptance of Terms

By accessing or using Appmeasurely ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including those who access the Service without an account.

2. Description of Service

Appmeasurely is a Connect. Measure. Grow. that provides attribution, fraud protection, cohort analytics, partner tracking, and related services for mobile applications. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• Accounts are subject to approval by our team before activation.
• One account per company unless otherwise agreed in writing.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Track users without appropriate consent and disclosure
• Transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to our systems
• Resell or sublicense the Service without written permission
• Use the Service for competitive intelligence against Appmeasurely
• Exceed your plan's usage limits without upgrading

5. Plans, Billing & Payment

• Paid plans are billed monthly or annually as selected at signup.
• All fees are non-refundable except as required by law or our refund policy.
• We may change pricing with 30 days' notice. Continued use constitutes acceptance.
• Failure to pay may result in suspension or termination of your account.
• Annual plan customers who cancel receive a prorated refund for unused months.

6. Usage Limits

Each plan includes limits on installs, events, apps, and team members. When you reach 80% of your limit, we will notify you. At 100%, new events may be throttled. You can upgrade at any time to increase your limits.

7. Data & Privacy

You retain ownership of all data you collect through our SDK. By using our Service, you grant us a limited license to process that data to provide the Service. You are responsible for obtaining appropriate consent from your end users. See our Privacy Policy for details.

8. Intellectual Property

Appmeasurely and its licensors own all rights to the Service, including all software, technology, content, and trademarks. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

9. Warranties & Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPMEASURELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and we will delete your data within 30 days unless legally required to retain it. Termination does not affect any payment obligations already incurred.

12. Governing Law

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
